Terms of use

These Terms of Use (“Terms”) govern access to and use of the website govoir.com and the services offered by Govoir. By accessing the Site, creating an account, or using the Services, the User acknowledges having read and accepted these Terms.

The website govoir.com is a service published and operated by BRISSOTO SARL, a Cameroonian company specialised in producing and providing digital solutions and tools. The formation certificate confirms the name BRISSOTO SARL and its registration with the CFCE in Yaoundé.

For the purposes of these Terms of Use, BRISSOTO SARL, as publisher and operator of the Govoir service, is referred to below as “Govoir”.

Purpose of the platform

Govoir operates a classifieds platform that allows private individuals and professionals, in particular, to:

  • publish listings;
  • search for goods or services;
  • contact other Users;
  • exchange through the messaging tools provided by the platform;
  • sell or buy goods or services;
  • use, when available, additional services offered by Govoir.

Unless expressly stated otherwise, Govoir is neither the seller nor the buyer of the goods covered by the listings.

Govoir acts primarily as an intermediary that connects Users.

Govoir connects Users. Unless stated otherwise, Govoir is not a party to the contract concluded between a seller and a buyer.

Acceptance of the Terms

Use of Govoir implies full and complete acceptance of these Terms.

When creating an account or using certain Services, the User may be asked to confirm this acceptance expressly.

A User who does not accept these Terms must not use the Services.

Access conditions and legal capacity

Browsing listings may be available without creating an account.

Publishing listings, using messaging, and certain other features may require creating an account.

The User must have the legal capacity required to carry out the acts they perform on Govoir.

Where applicable law requires authorisation from a legal representative, the User may not complete a transaction without that authorisation.

Govoir may restrict certain features to persons who have reached the age required for full legal capacity.

Creating an account

When registering, the User undertakes to provide accurate, current, and complete information.

Each account is personal.

The User is responsible for keeping their credentials confidential and for any activity carried out from their account, except in the case of fraudulent use for which they are not responsible.

Any suspicious or unauthorised use must be reported to contact@govoir.com.

Govoir may put in place mechanisms to verify a phone number, email address, identity, or any other information needed for the security of the platform.

A verification carried out by Govoir is not an absolute guarantee of a User’s identity, honesty, or solvency.

Publishing listings

The User is solely responsible for the content of the listings they publish.

They warrant in particular that:

  • the information published is accurate;
  • the photographs actually correspond to the good or service offered;
  • the stated price is not deliberately misleading;
  • they own the good or are authorised to offer it;
  • the listing complies with applicable laws and regulations;
  • the listing does not infringe a third party’s rights.

Listings must be published in the appropriate category.

Govoir may impose additional rules on presentation, photographs, the number of listings, categories, or required information.

Prohibited products and services

It is in particular forbidden to publish, sell, buy, or promote on Govoir goods, services, or content whose marketing is prohibited by applicable law.

The following are in particular prohibited when their marketing is illegal or regulated:

  • stolen goods;
  • counterfeit products;
  • narcotics and illicit substances;
  • unauthorised weapons, ammunition, and explosives;
  • forged administrative documents;
  • counterfeit currency;
  • identity documents;
  • personal data obtained unlawfully;
  • bank accounts or fraudulent means of payment;
  • child sexual abuse material;
  • illicit sexual services;
  • protected animal species or products;
  • medicines or health products sold in breach of regulation;
  • prohibited dangerous products;
  • goods that infringe intellectual property rights;
  • systems, services, or products intended to commit fraud or an offence.

This list is not exhaustive.

Govoir may prohibit additional categories in order to keep the platform safe.

Prohibited conduct

It is forbidden to use Govoir in particular to:

  • swindle another User;
  • impersonate someone;
  • carry out phishing;
  • send spam;
  • harass or threaten a person;
  • publish hateful or manifestly unlawful content;
  • attempt to access another User’s account;
  • circumvent Govoir’s security systems;
  • introduce viruses or malicious programs;
  • collect the Site’s data at scale without authorisation;
  • use unauthorised robots or automated systems;
  • artificially manipulate search results;
  • publish identical listings at scale;
  • use Govoir to conceal the fraudulent origin of funds or goods.

Moderation

Govoir may implement automated and human systems to detect fraud, prohibited content, and breaches of these Terms.

Govoir may in particular:

  • reject a listing;
  • change its category or visibility;
  • request supporting documents;
  • remove a listing;
  • restrict certain features;
  • temporarily suspend an account;
  • permanently close an account.

These measures may be applied in particular where there are reasonable indications of fraud, unlawful activity, a risk to Users, or a breach of these Terms.

Govoir may also cooperate with the competent authorities when the law so requires.

Relations between buyers and sellers

Unless Govoir is expressly identified as the seller, the contract relating to the advertised product or service is concluded directly between the seller and the buyer.

The seller is responsible in particular for:

  • the existence of the good;
  • its description;
  • its condition;
  • its price;
  • its lawful origin;
  • its conformity;
  • its delivery;
  • the warranties they grant;
  • and more generally compliance with their legal obligations.

The buyer must check the characteristics of the product before concluding the transaction.

Govoir recommends that Users exercise caution before any payment or handover of a product.

Professional sellers

Any User acting in the course of a professional activity must declare themselves as a professional when Govoir offers that distinction.

The professional seller remains responsible for complying with all legal obligations applicable to their activity.

They must in particular provide consumers with the mandatory information about their identity, their products or services, prices, payment terms, delivery, warranties and, where it exists, the right of withdrawal.

Using Govoir does not exempt any professional from their tax, commercial, administrative, or regulatory obligations.

Prices

Sellers freely set their prices, subject to applicable law.

When a Govoir service is paid, its price is communicated to the User before the purchase is confirmed.

Any applicable fees, commissions, or taxes are shown before the transaction is confirmed when Govoir is responsible for invoicing them.

Payments

Govoir may allow Users to make certain payments through partner payment providers.

In that case, specific conditions may apply.

Sensitive data relating to bank cards or means of payment may be processed directly by the payment provider concerned.

Govoir does not guarantee the permanent availability of any particular means of payment.

When the transaction is carried out directly between Users outside a payment system offered by Govoir, Govoir is not responsible for the payment made between those Users, subject to the liabilities imposed on it by law.

Delivery and handover of goods

When delivery or handover of a product is arranged directly between the seller and the buyer, the parties are responsible for agreeing its terms.

If Govoir later offers a delivery service or uses a logistics partner, specific conditions may complement these Terms.

Messaging

Govoir may provide messaging that allows Users to communicate.

The User undertakes not to use this messaging to send fraudulent, threatening, unlawful, or unsolicited commercial content.

In accordance with applicable law, Govoir may implement mechanisms to detect certain suspicious or unlawful activities.

Reporting

Any User may report a listing, an account, or behaviour they consider fraudulent, unlawful, or contrary to these Terms.

A report may be made through the features provided on the Site or at contact@govoir.com.

Govoir reviews reports and decides on the appropriate measures based on the information it has.

Fraud and transaction security

Govoir in particular invites Users to:

  • verify the identity of the other party when necessary;
  • never share their passwords or validation codes;
  • inspect the product before paying when possible;
  • be wary of abnormally attractive offers;
  • avoid payments to people whose identity is uncertain;
  • not send personal documents unless necessary.

Govoir cannot guarantee that no User will attempt to commit fraud.

Never share your password, Mobile Money codes, an SMS code, or your banking credentials. Govoir will not ask for them in a sale between users.

Intellectual property

The Site, its brand, logo, interface, software, databases, graphic elements, and content created by Govoir are protected by applicable intellectual property rights.

They may not be reproduced, copied, exploited, or distributed without prior authorisation when such authorisation is required.

The User retains the rights they hold in the content they publish.

By publishing a listing on Govoir, they nevertheless grant Govoir a non-exclusive licence to host, reproduce, technically adapt, and display that content only to the extent necessary for the operation, promotion, and distribution of the Services.

This authorisation ends when the content is permanently deleted, subject to technical backups and legal retention obligations.

Personal data

Govoir processes certain personal data needed to operate and secure the platform.

This processing may in particular concern:

  • account information;
  • contact details;
  • listings;
  • exchanges carried out through the platform;
  • technical connection information;
  • data used to fight fraud;
  • information relating to transactions when Govoir is involved in them.

Govoir processes this data in accordance with applicable Cameroonian legislation on the protection of personal data.

The User may exercise the rights recognised by applicable law, in particular rights of access, rectification, objection, or erasure when their conditions are met.

Cookies and similar technologies

Govoir may use cookies and similar technologies needed for operation, security, audience measurement, or improvement of the Services.

When the User’s consent is legally required, the technologies concerned are activated only after that consent is obtained.

Service availability

Govoir endeavours to ensure the availability and security of the Site.

However, the Service may be temporarily interrupted in particular because of:

  • maintenance;
  • an update;
  • a breakdown;
  • a network problem;
  • a security incident;
  • an external event reasonably beyond Govoir’s control.

Govoir does not guarantee permanent and uninterrupted availability of the Site.

Intermediary role and limitation of liability

Govoir acts exclusively as a platform connecting sellers and buyers. Unless expressly stated otherwise, Govoir is not a seller, buyer, carrier, or payment provider and is not a party to the contract concluded between Users.

The sale and all obligations arising from it are concluded and performed directly between the seller and the buyer.

As a result, subject to applicable mandatory legal provisions, Govoir cannot be held liable in particular for:

  • the existence, origin, quality, authenticity, conformity, or condition of a good;
  • a defect, apparent or hidden flaw, malfunction, or deterioration of the goods;
  • an incorrect or misleading description, photograph, or piece of information published by a User;
  • failure to deliver, late delivery, loss, theft, or damage to an item during handover or transport;
  • non-payment, late payment, partial payment, or fraudulent payment;
  • a forged document or a false payment confirmation presented to the seller;
  • a dispute concerning a refund or the return of a good;
  • the fraudulent, negligent, or unlawful behaviour of a buyer or a seller;
  • any loss resulting directly from a transaction concluded between Users.

Govoir does not collect, receive, or hold the purchase price of items sold between Users. The method of payment is freely agreed between the seller and the buyer and is carried out under their sole responsibility.

The seller is solely responsible for verifying that payment has actually been received before handing over their good to the buyer. Govoir does not guarantee any proof, notification, screenshot, or payment confirmation communicated by a User.

Likewise, the buyer is solely responsible for inspecting the good before acquiring it. Govoir strongly recommends seeing, inspecting, and testing the item before any payment.

Any question relating to delivery, handover of the good, payment, its condition, its conformity, or its refund must be settled directly between the seller and the buyer.

Govoir may offer communication, reporting, or moderation tools, but making them available does not constitute a guarantee of the transaction or an assumption of that transaction by Govoir.

Govoir may suspend or delete an account or a listing in case of suspected fraud or a breach of these Terms, without that intervention making Govoir responsible for the transaction concerned.

Nothing in this article may, however, exclude or limit a liability of Govoir where such exclusion or limitation is prohibited by an applicable mandatory legal provision.

See the item, check it, then pay. Govoir does not collect the price of sales between Users and does not guarantee screenshots or “confirmation” SMS messages.

Account suspension and closure

The User may request the closure of their account in accordance with the features offered by Govoir.

Govoir may suspend or close an account in particular in the event of:

  • fraud;
  • an attempted fraud;
  • repeated breaches of the Terms;
  • publication of prohibited content;
  • identity theft;
  • an attack on the security of the platform;
  • manifestly abusive use of the Service;
  • a legal obligation or a request from a competent authority.

Depending on the seriousness of the situation, suspension may occur without prior notice when immediate action is needed to protect Govoir, its Users, or third parties.

Deletion of listings and data

A listing may be deleted by its author or by Govoir under the conditions provided in these Terms.

Some information may nevertheless be retained after deletion when that retention is necessary to comply with a legal obligation, to fight fraud, for security, or to defend the rights of Govoir or a third party.

Links to third-party services

Govoir may contain links or allow the use of services offered by third-party companies.

Those services may have their own terms of use and privacy policies.

Govoir does not necessarily control those third-party services and cannot be held responsible for their operation when they are independent of Govoir.

Changes to the Terms

Govoir may amend these Terms in particular to take into account:

  • changes to the Services;
  • new features;
  • security requirements;
  • changes in regulation.

When the changes are material, Govoir may inform Users by any appropriate means.

The applicable version is the one published on govoir.com on the date the Service is used, subject to mandatory rules applicable to contracts already concluded.

Partial invalidity

If a provision of these Terms is declared void or unenforceable, the other provisions remain applicable to the fullest extent permitted by law.

Governing law and jurisdiction

These Terms are governed by Cameroonian law.

In the event of a dispute, the parties first endeavour to find an amicable solution.

Failing an amicable resolution, the dispute may be brought before the competent courts in accordance with applicable Cameroonian rules, without depriving a consumer of any mandatory protection they enjoy under the law.
